Terms of Service
These terms apply to your use of the Mesa procurement platform at mesa.live (“Mesa”). By registering a company, creating an account, or submitting a quotation through Mesa, you agree to these terms. If you use Mesa on behalf of an organization, you confirm that you are authorized to accept them for it.
1. Accounts
- Mesa is for business use. A company registers first, and its account becomes active only after Mesa reviews and approves the registration.
- Your organization’s administrators manage its users, roles, and module access, and are responsible for everyone they add.
- Keep your sign-in details and company code confidential, and tell us promptly if you believe your account has been misused.
2. Plans and limits
- Your plan sets limits such as procurements per month, providers per procurement, and user seats. Current plans are listed on the Pricing page.
- We may change plans, limits, or prices. Changes to a paid plan apply from the next billing period, and we will tell organization administrators in advance.
3. Buyers
- You are responsible for the procurements you create, including their accuracy, the documents you share, and whether your process meets the laws and internal rules that apply to you.
- Evaluation, approval, and award decisions are yours. Mesa provides the tools to run and record them.
4. Providers
- The information, quotations, and documents you submit must be accurate, and you must be authorized to submit them.
- Your private link gives access to your submission. Keep it confidential and don’t share it.
- Submitting a quotation does not guarantee an award.
5. Mesa’s role
Mesa is a software platform. We are not a party to any contract between a buyer and a provider, and we do not verify providers’ identities, qualifications, licenses, or submissions. Buyers and providers are responsible for their own dealings with each other.
6. Acceptable use
You must not:
- use Mesa for anything unlawful, fraudulent, or misleading, including bid rigging or collusion;
- upload malware or files you don’t have the right to share;
- try to access another organization’s data, another provider’s submission, or any part of Mesa you are not authorized to use;
- interfere with, overload, scrape, or reverse-engineer the platform.
7. Your content
You keep ownership of the content you and your users submit. You give Mesa permission to store, process, and display it as needed to provide the platform to you and to the parties you share it with. Our Privacy Policy explains how we handle personal information.
8. Availability and changes
We work to keep Mesa available and secure, but we don’t guarantee uninterrupted service. We may update, change, or discontinue features, and we will give reasonable notice of changes that significantly affect how you use Mesa.
9. Suspension and termination
We may suspend or close an account that breaks these terms or puts the platform or other users at risk. You can stop using Mesa at any time. On request, we can help your organization export its data before its account is closed.
10. Disclaimers and liability
Mesa is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or losses arising from procurement decisions, provider performance, or dealings between buyers and providers.
11. Governing law
These terms are governed by the laws of the Republic of the Philippines.
12. Changes to these terms
We will post updated terms on this page and change the date above. Continuing to use Mesa after an update means you accept the updated terms.
